About the Role:

A rare and highly sought after in-house counsel position for an industry leading, privately owned Australian company in Canberra. This is a fantastic opportunity to develop in-house legal career, work on highly complex matters and to be pioneering contributor to embedding the legal function within CDC Data Centres in Australia and New Zealand. 

The Legal and Risk function within CDC Data Centres (CDC) is responsible for providing advice, support, guidance, and clarity to the business in identifying and mitigating potential risks. 

The Legal Counsel shall be responsible for supporting the General Manager, Legal & Risk (GM) in various capacities as part of CDC’s compliance, risk, and legal initiatives. The Legal Counsel will work closely with the GM on a range of assignments, but primarily: drafting and negotiating contracts (on both supply-side and client-side); performing research tasks; drafting advice on a range of matters and be a contact point for ad-hoc queries from around the organisation. The Legal Counsel will also assist with ensuring that contractual and legal obligations are understood throughout the business and assisting with awareness, communication, and training exercises. 

Additionally, the Legal Counsel will be expected to take the lead in uplifting process and procedures within the Legal and Risk function – ingenuity and innovation are a must. The role will require a hands-on approach to addressing legal issues which the business faces day-to-day, with the primary goal of adding value to CDC through proactive identification and mitigation of risk.

Other responsibilities include:  

  • Being a trusted legal advisor to the business, capable of acting quickly on queries touching on a broad range of areas of law, including contracts, corporate, property, construction, employment, ICT and IP.
  • Being proactive and astute in advising the business, drafting and negotiating contractual documents, articulate contractual risks and put in place control and reporting mechanisms for the ongoing management of key risks.
  • Advising the business with respect to property acquisitions, commercial leases and other property law matters.
  • Aiding development of the legal function within CDC including a fit-for-purpose contracts data base.
  • Support the continued scaling and growth of CDC and development of new products and services through commercial, market and contractual analysis. 
  • Assist with appraising supplier and customer proposals, bids and contracts, as well as assist with recommending and negotiating improved outcomes for CDC.
  • Assist with the establishment of pragmatic, best practice contract management processes. 
  • Assist with providing detailed commercial analysis through the development of larger contracts and bids, and support with the drafting of key contracts, bids and tenders. 
  • Educate and train employees on regulations, standards and best industry practice relevant to the various functions at CDC.

About You:

  • 3-5 years post qualification experience as a lawyer in corporate, commercial, ICT, real estate or construction practice areas (in-house experience preferred, but not essential).
  • Qualification in law with a current practicing certificate.
  • Advanced interpersonal skills and oral communication skills. Able to present confidently to a broad stakeholder base. 
  • Advanced numeracy skills and strong attention to detail but with the ability to stand back and appraise a problem from a strategic or broader relationship perspective.
  • Excellent written skills with the ability to draft concise documents.
  • Passionate about the law, ethics, compliance and uplifting standards and conduct in the workplace.
  • Demonstrated ability to meet deadlines while managing multiple complex projects.
  • Demonstrated high levels of initiative and strategic/critical thinking and decision making.
  • Display a strong commitment to customer service with a focus on deliverables.
  • Pragmatic approach to work, comfortable working both hands-on and “in the strategy”. 
  • Enthusiastic to learn and develop professionally with a “can-do” approach.
  • A team player with strong interpersonal skills as well as exemplary written and oral communication skills 
  • Adept in building relationships to positively influence decision making.
  • Highly developed administrative capabilities (including document management and systems of record).
  • Self-motivated to maintain knowledge of current developments in area of expertise.
  • Attention to detail with an ability to prioritise work activities.
